Fox News’ Mark Levin on Wednesday went ballistic on Chief Justice John Roberts, who issued a rare statement where he called it not “appropriate” for President Donald Trump to call for the impeachment of a federal judge.
“I would say that John Roberts, who I knew before he was a judge when we both worked in the Reagan administration — it’s time to grow a pair, judge,” said Levin on Fox News host Martha MacCallum’s program.
Levin’s remarks arrive after Roberts rebuked the president for raging at U.S. District Judge James E. Boasberg, who issued an order to block the expulsion of hundreds of immigrants to a prison in El Salvador over the weekend.
The flights — which carried immigrants allegedly affiliated with Venezuelan gangs, though administration officials have provided little in terms of evidence — still went ahead, sparking a legal battle that the Trump administration has escalated in recent days.
On Wednesday, White House press secretary Karoline Leavitt accused the judge of being a “Democratic activist” despite his history of ruling in Trump’s favor.
Levin, in a rant on Fox News, slammed what he referred to as a “judicial oligarchy of unelected judges at the trial court level” who have challenged the president on matters tied to human resources, border security and immigration.
Moments later, MacCallum noted that Roberts weighed in on the district judge’s “right” to his decision and asked Levin what the Supreme Court should do about the case.
Levin, after referring to a federal judge who recently ruled that the Trump administration pay out about $2 billion in frozen foreign aid to humanitarian groups, questioned “how the hell” hundreds of “unelected” federal judges get to rule that they don’t like ideas by Trump. (As the chief justice pointed out in his statement, disagreements about judicial decisions in the U.S. have been worked out in the appellate process for more than 200 years.)
Nevertheless, Levin declared, “This is exactly what Locke and Montesquieu and Jefferson and Madison warned.”
“When you have a combination of branches rather than separation of branches … you have a tyranny. And I don’t care about what John Roberts pronounces from the bench. Do your job, Chief Justice of the United States. Don’t get into the political fight. Fix it.”

He continued, “Because if you don’t fix it, we’re going to lose our constitutional construct, or Congress is going to have to figure out some way to fix it.”
